SUMMARY OF DISCLAIMER
PrismEmail is provided as a service of
Vault Information Services
LLC. It is our intention to provide the best, most complete, and most effective
service possible. However, Vault Information Services LLC disclaims all liability and
responsibility for the user's use of this service. The service is provided entirely "as-is"
and the user assumes full responsibility for the use of the service provided by
PrismEmail. By utilizing this service, the user explicitly indemnifies and holds harmless
Vault Information Services LLC from any and all liability regarding the use of said service.
In absolutely no event shall the liability of Vault Information Services LLC exceed the
amount paid for services rendered, nor shall it be liable for consequential damages due to
the improper functioning of the service, be it due to a problem with the service or due to
user error..
TERMS OF SERVICE
PrismEmail.com (hereafter "PrismEmail") is a service offered by Vault Information Services LLC
(hereafter "VIS"), a Colorado Limited Liability Company, the intent of which is to reduce
the burden of unsolicited electronic mail ("spam") on the customer (herafter "User").
- Nature of Service. User explicitly understands and accepts that PrismEmail
is an email filtering service, the purpose of which is to block undesirable email while at
the same time permitting desirable email to reach the user. User understands and
accepts that while PrismEmail makes an effort to perform this function successfully, the
nature of the service is such that desirable emails may be blocked from time to time.
User explicitly understands and accepts this inherent risk of using an email filter
and understands that the User is responsible for reviewing the blocked email to
verify that desirable email has not been blocked.
- Permission to Block Mail. User explicitly grants PrismEmail and
VIS permission to block email which are judged to be undesirable and affirms
to 3rd parties, such as the senders of such undesirable email, that the User does
not wish to receive such email and is utilizing PrismEmail in order to accomplish
that goal. PrismEmail is not engaged in censorship nor interfering with existing
business relationships or contracts; rather PrismEmail is carrying out the
User's goal and desire of blocking email deemed to be undesirable, and User
is voluntarily using PrismEmail to that end.
- Legal Limit of Liability. User explicitly indemnifies and holds harmless VIS
it's agent, employee, owner and other representatives, for any and all losses or claims that
arise from the use or misuse of PrismEmail, including but not limited to the incorrect
blocking of desirable mail, the failure to block undesirable mail, failure of PrismEmail
to successfully download email from the User's POP3 account, loss of email, and any
and all consequential damages that may arise due to any of the previously disclaimed possible
failures.
- Financial Limit of Liability. User understands and accepts that in no
case shall PrismEmail or VIS, jointly or separately, be financially liable
for an amount greater than the amount the User paid for the service.
- Uptime Performance. VIS will make a professional effort to ensure that
PrismEmail is accessible and functional as reliably as possible. However, network
interruptions may occur at any point in the Internet infrastructure as well as at the
PrismEmail server(s) or PrismEmail's Internet provider and VIS and
PrismEmail cannot make specific guarantees as to the level of reliability that
the User will experience from any specific point on the Internet.
- Refund Policy. PrismEmail will generally not issue refunds since User
is granted a 30-day no-risk, no-obligation free trial of the service. Requests for refunds
will be handled on a case by case basis and the circumstances will dictate whether a
refund is granted. If a refund is granted, the refund will be based on the pro-rated
volume consumed or the pro-rated time transpired, whichever is less, and will be made to the
credit card used to pay for the service. If payment was received by some other means, the
refund will be made by a check payable in U.S. dollars on a U.S. bank being sent to the
customer within 30 days of the refund being authorized.
- Extended Downtime Policy. If, for any reason, PrismEmail's server(s)
suffer downtime for a period of more than 72 consecutive hours, User will have
their paid subscription extended by the number of hours the server(s) were down. This
will not apply to free trial accounts and only applies to downtime caused by
PrismEmail or its immediate Internet provider.
- User Agreement Not To Inappropriately Promote PrismEmail. User is encouraged to
alert others to the existince of PrismEmail so that others may enjoy the benefits
of reduced spam. However, under no circumstance will User promote PrismEmail
by method of spam, nor will User promote PrismEmail on any site of
questionable morals or values, including pornographic, racist, or illegal sites. Promoting
PrismEmail in any of these manners will result in User's account being
cancelled immediately and permanently.
- User Agreement Not To Use PrismEmail to Test Spam. User agrees that
PrismEmail may under no circumstance be used with the intent of intentionally
receiving spam to determine whether that spam would have been caught by PrismEmail.
Engaging in this kind of testing will result in User's account being cancelled
immediately and permanently.
PRIVACY POLICY
PrismEmail and VIS jointly and separately make and
extend the following privacy policy to the User:
- Email Privacy. The nature of PrismEmail is such that the email of the
User will pass through the PrismEmail server(s). The mail that passes
through our servers will not be inspected, read, or monitored by any agent,
employee, owner or other representative of PrismEmail or VIS, nor shall
we knowingly permit any third party to inspect, read, or monitor such email traffic
except when so ordered by a competent court or legal authority.
- Email Filtering Is Automated. The PrismEmail server(s) that perform
the email filtering service do so in an automated manner such that no human being is
involved in said filtering.
- Spam Reports are Reviewed. A human being will read and review email that
User reports as spam. These reports are optional but are highly encouraged. Email
that is reported as spam will be reviewed by a human being in order to create new filters
and improve the efficiency and accuracy of PrismEmail. This emails are not linked
to User's account and are completely purged and deleted once useful filtering
information has been obtained from the review. In the event the spam contains any
personal information, said information will be discarded and in no way retained or used
by PrismEmail or VIS.
- User Information not Online. The PrismEmail service was and is designed
from the beginning to offer security to the User. User's personal
information, including name, address, city, state, postal code, country, and credit
card number, are not permanently stored on an Internet-accessible server. When
User submits said personal information it is stored online only briefly before
being offloaded to an external server that is not accessible via the Internet. The
information is then purged from the Internet server.
- No Sharing of Personal Information. Neither PrismEmail nor VIS
will share, sell, give away, or otherwise transfer any personal information regarding
User to any third party, except when so ordered by a competent court or legal
authority. PrismEmail and VIS explicity will NOT transfer the User's
name, address, city, state, postal code, country, or credit card number to any third
party.
- No Spamming. Neither PrismEmail nor VIS will send the User
spam before, during, or after User's subscription to the service.
- Limited Emailing Permitted. PrismEmail does reserve the right to contact
User via email to notify the User that their account has or is about to
expire, to notify the User of charges to his or her credit card by VIS,
to optionally notify the User of email that has been blocked by the service in
the last 24 hours, and, when warranted, notify the User of substantial news or
information regarding the service. Neither VIS nor PrismEmail will
send email to User that is not substantially related to the service.
- Browser Cookies Required. PrismEmail uses client-side browser cookies in order
to maintain browser sessions when the User logs into the service. These cookies
are mandatory in order for the service to work and blocking them will prevent the user
from logging on.
- No 3rd-Party Embedded Cookies or Images. PrismEmail does not load images,
pages, or cookies from 3rd-party sites for any purpose. Cookies at PrismEmail are
created and read only by PrismEmail.
- Cookies Used For Technical Purposes. PrismEmail uses cookies only
for the technical purpose of maintaining user sessions when logged in and are not
shared with 3rd-party sites.
- Aggregate Data May be Shared. PrismEmail reserves the right to
compile aggregate, non-personal data and share this information with the public or
3rd-parties. No personal, identifying information will ever be shared nor will
the data of a specific user be shared--rather, PrismEmail may compile and
share data regarding system-wide spam and email volume for the purpose of tracking
spam trends and/or promoting PrismEmail.
